Thank you HOA Members

Dear Fellow HOA Members:

Thank-you for your time and opinions. We have enjoyed meeting our neighbors while going door-to-door and sharing views on making our community better. Last night we had 49 neighbors attending the Special Meeting and hope to see you all again very soon to "elect" a new HOA board who will stand before the membership for elections according to our by-laws.

We had 29 votes to remove/retire three officer positions on the HOA board (more than a quorum of 22 or 19 depending on viable "members in good standing" as defined by accounting records of Jim Curley Properties). We filed 25 proxy ballots (members unable to attend meeting but voted by ballot) with the secretary and several were declined. A lawyer, Mr. Billy Weaver, (and past HOA board president of another Jim Curley managed property), attending our meeting at the invitation of Jim Curley yet paid for by us, the HOA members, stated he "represented the HOA members." Mr. Weaver cited a section of the by-laws that pertained to “elected” board members and took the liberty to interpret that section as valid for our unelected board members. He successfully used the interpretation to block our ability to address the second issue on the petition; to hold an official election. Lawyer won, members lost. Please contact Jim Curley Properties by email and phone with your concerns. Please ask for HOA board meeting times, dates and locations and attend them. Our understanding is HOA board meetings are the third (3rd) Thursday of the month and have been held in the middle of Razz restaurant at 6:30 p.m. We attended the last HOA board meeting there on 07/17/08. Please ask our HOA board for minutes of HOA board meetings from 2008 be posted on the website (we pay for) "nashborogreens.com" or forward them to Mindy (nashborogreens@aol.com) to post on our blog at "thenashborogreensunderground.blogspot.com" so that we may view HOA board activity.
